Reading Man Arrested for Quoting Bible in Public

It took less than sixty seconds of standing on a sidewalk for Damon Atkins to be placed in handcuffs and arrested for quoting a portion of a Bible verse.

On Saturday morning dozens of people were gathered outside the Reading City Hall on Washington Street to participate in the city’s first ever “Pride March and Rally” endorsed by Mayor Eddie Moran. At approximately 10:05 a.m. Atkins arrived at a public sidewalk across the street from City Hall.

In less than a minute he found himself in handcuffs.

The entire incident was captured on film by Matthew Wear of Reading, Pennsylvania, who told The Lancaster Patriot that he had been preaching prior to Atkins’ arrival and was told to stop by the same police officer who later handcuffed Atkins.

Wear said he preached for about twelve minutes and then began filming the event from across the street.

Wear posted the video to YouTube, where it has garnered nearly 2,000 views in two days.

The video begins with Wear narrating and explaining that he preached until “a cop got in my face, laid hands on me, and threatened to arrest me if I didn’t stop.”

“They got drag queens, they got children here,” Wear said in the video. “They’re about to do a flag raising ceremony in this Satan cesspit.”

About a minute into the video, Atkins can be seen at a distance heading toward the event.

“It looks like some more men just showed up to support us,” Wear says at the 1:48 point in the video. “This cop’s going to give them a hard time.”

The video shows Police Sergeant Bradley T. McClure approaching Atkins, and the two interact for approximately 25 seconds.

Atkins can be heard saying “This is public property.”

McClure can be heard saying “let them have their event” and “respect them.”

In the video, Atkins tells McClure that he is respecting the people in attendance and said, “You know who’s cheering for us – the people that are in hell.”

Atkins later told The Lancaster Patriot that he was referring to the parable of the Rich Man and Lazarus in the Gospel of Luke, wherein a rich man in torment begs Father Abraham to send someone to warn his brothers about the place of torment.

Wear’s video then focuses on McClure as he walks away from Atkins. Atkins can then be heard saying, “God is not the,” and McClure immediately reapproaches Atkins and handcuffs him.

Atkins told The Lancaster Patriot that he was going to quote a portion of 1 Corinthians 14:33 – “God is not the author of confusion” – but did not finish the quote because he stopped when he was handcuffed by McClure.

According to an affidavit of probable cause, McClure claims that “[Atkins] was carrying a sign with a slogan written on it that showed his opposition to the event.”

The video footage shows Atkins holding a sign that read “JESUS SAID GO AND SIN NO MORE.”

In the affidavit, McClure also claims that Atkins “began to yell to the people” attending the pride event.

“I immediately approached him and told him that, while he was free to stand on that side of the street and hold his sign,” McClure wrote in the affidavit, “he could not cross the street nor yell comments intended to disrupt the event.”

McClure added that Atkins “said he understood.” But the video does not show Atkins agreeing to remain silent and Atkins told The Lancaster Patriot that he never agreed to McClure’s instructions.

The affidavit continues with McClure claiming that in less than a minute Atkins “resumed yelling derogatory comments to the people at the event.”

The video records the only words from Atkins as “God is not the” immediately prior to McClure arresting him.

A court document provided to The Lancaster Patriot shows that Atkins was charged with “Disorderly Conduct Engage in Fighting.”

A criminal complaint from the Reading Police Department provided to The Lancaster Patriot explains that a violation of the Disorderly Conduct statute entails “the intent to cause substantial public inconvenience, annoyance or alarm, or recklessly creating a risk thereof, he engages in fighting or threatening, or in violent or tumultuous behavior” and that Atkins “despite being warned by police just moments prior, yelled derogatory comments at an organization that was holding a permitted event.”

A copy of an Affidavit of Probable Cause provided to The Lancaster Patriot shows that Sgt. McClure requested that Atkins be arraigned for disorderly conduct, a misdemeanor offense.

As Atkins is being handcuffed in the video, the crowd at the pride event can be heard cheering his arrest.

Atkins agreed to meet with The Lancaster Patriot to explain that the reason he went to the event that day was because Jesus Christ changed him, and he wanted to tell others.

“The main reason I was there was because of love,” he said. “Because Jesus has taught me to love my neighbor as myself.”

He attended another pride event earlier in the week and said a man told him that “if I had a gun, I would shoot you in the head.”

Atkins said the message of repentance is viewed as hateful simply because it does not encourage the sinful behavior that is being celebrated by the culture.

“What is love? Is that love that your pastor tells you that you can be a homosexual and enter the kingdom of God?” he said. “That’s not love.”

Atkins told The Lancaster Patriot that he was cited as making “derogatory” comments but was simply quoting from the Bible.

“Now in this country, ‘God’ is a derogatory term,” Atkins told The Lancaster Patriot. “That makes me sick to my stomach.”

Atkins’ court date is scheduled for June 16, and he said he is hoping Alliance Defending Freedom will represent him.

Atkins said he is discouraged by the pride celebrations in Reading and the actions of the police officer but will continue to warn people about the dangers of sin.

“It’s all going to be sorted out in the end,” Atkins said.

[Editor’s Note: On June 7, the Berks County District Attorney’s Office announced that all charges against Atkins have been dropped.]

        You are absolutely right. I hope Mr. Atkins sues the city for violation of his civil rights. Don’t let these people off the hook. Freedom of speech is #1 for a reason and the officer’s tyrannical behavior should be called out and in my opinion, he should be suspended for the violation of Mr. Atkins right to speak freely. He wasn’t confrontational in any way. Disgusting. I will be making a complaint to Reading police in support of a brave man calling out these displays for what they are. Deviant.

          Officer Bradley T. McClure—who initiated arresting Christian Brother Damon Atkins—needs to be FIRED, not suspended, and also needs to be prosecuted for perjury (he blatantly lied multiple times under oath in his affidavit to the magistrate and court in order to try to substantiate his wrongful arrest). Moreover, he also needs to be charged and prosecuted for abduction, assault, and battery. Lastly, he needs to be sued for false arrest, assault, battery, wrongful imprisonment, free speech violations, and religious exercise violations. I will also be trying to make a complaint to the Reading Police Department about Officer McClure illegally doing these things.

        Exactly! Fire that police officer immediately for distorting the truth of the events to accommodate the woke agenda. Mr. Atkins was conducting himself in a peaceful manner and was disturbing or causing harm to anyone. I hope the arresting officer is removed from his position and never allowed to work in the capacity of a law enforcement agent in the future for his ability to easily lie and try to pull a power trip on someone that disagrees with his views and opinions. His overstepped his authority. After a day in court, I pray we have a sane and God-fearing judge who can watch this video and then read the police report to clearly see what a liar this cop is and reprimand him appropriately.

    I think someone ought to inform the police that it is not a crime to quote from the main text of the ‘official’ state church, the Christian Church, (whether anyone is a member or not), which the King himself has recently sworn, in public, to uphold. It is also not a crime to state your opinion, or is it now?

      This idiot cop trampled on the constitution. Deserves every lawsuit coming to him, the Reading police department, and the city of reading for employing a moron.

      The man did nothing violent and was in with in his rights to preach in public. The fact that people cheered a man’s right being blatantly violated by the police speaks volumes about the kind of people they are.

    Sue them into oblivion, this is a clear 1st amendment violation. No law overrules the constitution, he can protest/yell as much as he wants, and “derogatory” comments, which I guarantee is a lie, is protected speech. This is a slam dunk case, he needs to fight it because he will absolutely win

        Doesn’t matter if they had a permit for their event. The government cannot shut down free speech on public sidewalks or streets in order to appease a group or to prevent them from being criticized by people on such sidewalks and streets. The Christian man had a right to travel upon such sidewalks and streets, and a right to yell whatever he wanted while on such. Imagine a society and world where people on public property could be arrested for yelling. A woman could be arrested for yelling “Help, he’s trying to rape me!” If a woman yelled such, it would no less “disturb” their event than the Christian man yelling “God is not the author of confusion.” In both cases, the event would be “disturbed,” yet in both cases it would be and is lawful for a woman to yell such and lawful for a Christian to yell such. The government cannot determine what you can and cannot yell. When it does, it is selecting approved speech and disapproved speech, and such violates the First Amendment. The officers need to be fired, sued, and to pay a huge financial penalty to this Christian man for the very illegal and unconstitutional actions they knowingly took against him and then for lying in an affidavit to try to substantiate their illegal decision to arrest him.

        Ditto. I would SO contribute to his defense. What that officer did was pretty much textbook anti-First Amendment. Should the statute be upheld I hope it gets overturned on appeal. I do believe both other officers need to be named in the suit for abuse of office charges.

          Attempting to destroy the career of a cop merely doing their job at an event with a legal permit is reprehensible. This matter will, no doubt, end up being dismissed because the “gentleman” in question either on June 16, or there about, anyway. Fortunately, no one was injured. No harm; no foul.

            The officer has to be dumber than dirt if this is what we get out of the police training and he wasn’t even performing his job correctly. Any officer should understand the most basic of rights or they don’t deserve the badge in the first place. A 4th grader could have innately understood that cops have no right to stop someone from preaching in public. He wasn’t doing his job. He was usurping authority in a manner that is in violation of the constitution. There is more than one kind of violence. Injury to your body is one, but illegal arrest is another. Violence that crushes free speech is still lawsuit worthy. I don’t know why people think like you Cody, I assume you are a ghost account for the idiot cop who did this.

            I would suggest that the officer in question destroyed his career all on his own.
            IMHO, your attempt to villfy and cast guilt towards those who believe the officer should be fired, lacks proper reasoning at best.
            Would you have the same stance if a bus driver got into an accident most likely caused by the fact they were legally intoxicated at the time? They were “just trying to do their job” just as you correctly state the officer was doing…….. IMHO, the 1for1 similarities should be obvious in both the fictional and real life situations.
            Both were violating written law, but more importantly, they both also violated their moral/ethical duty to their job and the public by knowingly doing so.
            And in both cases again, the principles destroyed their own careers, needing no help from observers.

    There has already been at least one case for almost the same thing decided at the appellate level in favor of the defendant. My recollection being a Christian Evangelist named Michael Marcavage, of Repent America, who protested with a bullhorn a speech being given by then Gov. Ed Rendell, in a public place. Convicted in that case, and then overturned on appeal, that he had the same public-space First Amendment right as even a Governor, in this case Mr. Atkins wasn’t using a bullhorn, and most likely had no legal obligation to remain on the other side of the street, despite cooperatively doing so at the police officer’s direction. There is absolutely no excuse for this police officer’s ignorance of the law, no excuse that the officer’s superiors did not immediately order him to drop the charge, and absolutely no excuse, indeed, incompetence, that officers were assigned to a controversial street event without the training as to what is legally permissible protest. I truly feel for Mr. Atkins. While I hope that the law will amply compensate him for this egregious abuse, one does not have to experience being arrested and placed in handcuffs and a cell to appreciate how upsetting this must be for him. I hope and pray that God fills his heart with faithful joy.

      There have been countless cases where what McClure did was ruled unconstitutional. It’s time that laws are passed that hold police officers accountable for trampling the rights of law-abiding citizens. Wasting time like this is unnecessary. LEO’s feel empowered to harass Christians because they don’t fight back. If it was a bunch of BLM protesters, Gay Pride protestors or Antifa protesters they leave them alone out of fear of being harmed physically.

    I was wondering if the Reading Police Department is aware of the First Amendment to the US Constitution? It allows for freedom of religion, the press, speech, assembly and petition. Damon Atkins was exercising his rights on the streets of your city and was arrested for his assembly, use of speech and religion. How could the exercise of these rights be interpreted as disorderly conduct? Should the law not be equally applied to all citizens of Reading? Would he have been arrested if quoting the Quran?

    The conduct of Sgt. McClure is not only abhorrent to the principles of the First Amendment, they are unbecoming a officer of the law.. I am a true believer in the rule of law and support the police whole-heartedly which is why this situation warranted this email.. Sgt. McClure should be reprimanded by the Chief publicly for this act and I am sure you will be hearing from Mr. Atkin’s attorney shortly.

    Whether you are supportive or not of pride parades, I would like to point out that while Sgt. McClure told Mr. Atkins to let them “have their day”, they actually have a whole month. 79 years ago today the landing at Normandy took place with 4,144 US soldiers killed. Memorial Day is only one day long. They died so pride flags could wave.

    This is how they do it. The police were wrong and they know it. But it is easier to ask for forgiveness than it is to be fair and just. They just wanted to defuse the situation and the easiest way was to arrest and drag away the harmless Christian than to risk the dangerous people across the street becoming violent.
    Seen it happen before… the innocent and harmless are arrested because it is just easier to do that than risk the ire of the mean and ugly.

    Bradley McClure and other LEO’s are going to regret the day they put law-abiding citizens in jail. Anyone who watches the video knows there was no disorderly conduct. McClure violated this man’s First Amendment rights and in the process stomped all over the U.S. Constitution. How does the left get away with labeling those on the right as fascists, homophobes, racists and misogynists? I always see it form LEO’s and those on the left.

    He should check with a lawyer as to first amendment issue and the arrest under the Disorderly Conduct “Derogatory” words charge. It appears that it was a false arrest under a false charge. That’s a big complaint against a law enforcement officer and agency.

    Very good article, old tactic. We were fighting for this kind of testifying 30 years ago in front of abortion mills, which friends of mine did, alongside other people taking the conscious risk of arrest for trespassing (me and many others). This Sgt. McClure actually did a decent job — didn’t rough anybody up, which you sometimes get. Notice that he slow walked the individual around the corner and tried to help him get his knapsack off without cutting it off and ruining the knapsack. Decent. My guess is that Sgt. McClure had orders from the mayor to lock up anybody after the first warning, and that was because the mayor was clueless about the First Amendment, and so was the sergeant. For that reason, the ACLJ or other outfit will quickly learn the mayor up on what is legal and free vs. what is arrestable misdemeanoring. Then Sgt. McClure will find himself in a mess of the mayor’s making. That is a familiar situation, too. The police mainly go one of two ways in a case like this: (1) jerkoff or (2) efficient, firm but not unkind. Occasionally you have a cop who acts with compassion.

    THREE police officers for this one Christian doing absolutely NOTHING wrong? at no point did the man resist yet three police officers are shown in the video, one is seen doing an illegal search of his backpack! Then the lies in the affidavit that are CLEARLY dispelled by the video evidence. This police officer has committed perjury, filing false statements on a government form. Not to mention all the other infringements of a citizens rights the police officer stomp all over. The police officer needs to be dismissed and prosecuted for perjury. Please make this as PUBLIC as possible and demand a public hearing for the charges.

    Sgt Bradley Mclure is a charicature of a real law officer. He’s a dereliction of duty officer, color of law enforcement official.
    When he throws away the Constitution and makes up this crap, he’s on his own, we don’t owe him a defense.
    The Supreme Court ruled that the freedom to speak includes a freedom to be heard, this officer missed at least half of the law.
    The actual charge against Damon Atkins is perverse and untrue.

    The part of the affidavit where asshat Mcclure says “i told them they could not be disruptive” is against the law. He does not have the authority to tell anyone they cannot be disruptive.     Section 242 of Title 18 makes it a crime for a person acting under color of any law to willfully deprive a person of a right or privilege protected by the Constitution or laws of the United State.

    As a Pennsylvania, this story offends and embarrasses. Often, I will proudly state something like, “… the Constitution of the USA is a good starting point, but Pennsylvania’ constitution enshrines greater protections for our God given rights.” Or, “Pennsylvania has an excellent constitution with a long tradition of public support and judicial defense. Not so much today.

    Reading would be well advised to settle this matter directly after receiving a demand for damages. It can only get a lot worse from the $50k-75k they will pay then. Suspend that Sargent for a month and knock him down to corporal thereafter sending him to civil rights in Pennsylvania and the USA training.

    Sick and tired of the kneejerk respect the police b/s. They gotta give respect to get it. Moreover, when was the last time you ever saw a parade for a roofer that died from a fall? The Answer: never happens. However, roofers, truckers and otherwise employed men (it is significantly more men) die every single day in workplace accidents. Thinking of it. Didn’t Reading just have 6-8 men die in a candy factory accident. Was there a parade in Reading for those men. (I do recall reading only Hispanic male names.) The police, every bureaucrat, and every government employee whatsoever gets enough respect and thanks for working/service. It is called good steady pay and a too generous benefit package.
